This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “you”) and the developer of Tonic (“Licensor”, “we”, “us”, or “our”) for the Tonic mobile application, including any updates, content, and documentation provided with it (collectively, the “Software”).
By installing, copying, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
The Software is intended only for individuals who are 18 years of age or older. By using the Software, you represent that you meet this age requirement. If you are under 18, you are not permitted to install or use the Software.
Subject to your compliance with this EULA and the applicable Platform Store rules, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use one copy of the Software on a device that you own or control, solely for your personal, non-commercial use.
This license does not allow you to use the Software on devices you do not own or control, nor to distribute or make the Software available over a network where it could be used by multiple devices at the same time, except as expressly permitted by the Platform Store.
Except to the extent permitted by applicable law, you may not:
The Software is licensed, not sold. Licensor and its licensors retain all right, title, and interest in and to the Software, including all copyrights, trademarks, trade secrets, patents, and other intellectual property rights. No ownership interest is transferred to you under this EULA.
You retain ownership of the personal content you create in the Software, such as vanity records, diary entries, and profile information. That content is stored locally on your device under the technical design of the Software.
The Software includes official tutorial materials, visual assets, text, and other curated content provided for personal use within the App. Unless expressly stated otherwise, such content is owned by Licensor or its licensors and is licensed to you only as part of your permitted use of the Software.
Licensor may provide updates, upgrades, patches, or modified versions of the Software. Such updates may install automatically or require manual installation. This EULA applies to updates unless the update is accompanied by a separate license. Licensor is not obligated to provide maintenance, support, or future updates, but may do so at its discretion.
The Software may offer optional virtual coin packs, VIP subscriptions, and other digital items for use within the Software only. These items are licensed, not sold, and have no cash value outside the Software. They are not redeemable for money or exchangeable for value outside the App.
All purchases are processed by the Apple App Store, Google Play, or another authorized Platform Store. Billing, renewal, cancellation, refunds, and purchase restoration are governed by the Platform Store’s terms and applicable law. Licensor does not control Platform Store billing systems.
Restore Purchases may restore eligible non-consumable entitlements linked to your store account. Consumable virtual items that have already been used in the Software cannot be restored once spent.
The Software may request access to device features such as the camera and photo library so you can add images to your profile, vanity, or diary. You may deny or revoke permissions through your device settings, though some features may not function without them. Images you add remain stored locally on your device under the Software’s design.
The Software is designed to store most user data locally on your device. Licensor does not operate cloud synchronization for your vanity inventory, diary entries, or similar personal beauty data. You are responsible for maintaining backups of your device if you wish to preserve your data.
To the maximum extent permitted by applicable law, the Software is provided “as is” and “as available”, with all faults and without warranty of any kind. Licensor disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
The Software is a personal organization and learning tool. It does not provide medical, dermatological, or professional beauty advice. You assume all risk arising from your use of cosmetic products and techniques shown or organized through the Software.
To the maximum extent permitted by applicable law, in no event will Licensor or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, business, or goodwill, arising out of or related to your use of or inability to use the Software, even if Licensor has been advised of the possibility of such damages.
In jurisdictions that do not allow certain limitations, Licensor’s liability will be limited to the maximum extent permitted by law.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Software and uninstall it from your devices. Sections that by their nature should survive termination will remain in effect.
You agree to comply with all applicable export control and sanctions laws. You may not use or export the Software except as authorized by applicable law.
Your use of the Software may also be subject to the terms and policies of the Platform Store from which you obtained it, including Apple Media Services Terms or Google Play Terms of Service. If there is a conflict between this EULA and mandatory Platform Store terms, the Platform Store terms may govern to the extent required.
Licensor may modify this EULA from time to time. The revised effective date will be shown at the top of this document. Continued use of the Software after an update constitutes acceptance of the revised EULA.
